ADU Permits in Aptos: The 2026 Process, Fees, and Timeline
Aptos is unincorporated, which means your ADU permit does not come from a city hall. Santa Cruz County reviews it, through the county’s online ePlan system, and county code sets the local rules. The county reviews ADU building permit applications within 60 days of submittal, approval is ministerial with no public hearing, and the county’s size rules are tied to your lot: 850 to 1,000 square feet on lots under an acre, and up to 1,200 square feet on an acre or more.
The short version: Santa Cruz County is your permit authority in Aptos. Detached ADUs run 850 square feet (studio or one-bedroom) or 1,000 square feet (two or more bedrooms) on lots under 1 acre, and 1,200 square feet at 1 acre and up, with at least 800 square feet always allowed. Setbacks are 4 feet side and rear. Generous county fee waivers apply. We run the whole process for you, with a permitting budget built into one project price.
The Aptos ADU permit process, step by step
- Confirm you are in county jurisdiction. Most of Aptos, along with Rio del Mar, Seacliff, and La Selva Beach, is unincorporated Santa Cruz County. (Capitola and the City of Santa Cruz run their own counters with different rules.) Our Can I build? rules lookup sorts this out by address.
- Size the unit to your lot. Under 1 acre: 850 square feet for a studio or one-bedroom, 1,000 square feet for two or more bedrooms. At 1 acre or more: up to 1,200 square feet. Every lot is entitled to at least 800 square feet regardless.
- Design to county standards. Minimum side and rear setbacks are 4 feet, with front setbacks following the zone district unless waived. Detached ADUs inside the Urban Services Line may be 16 feet tall, or 21 feet with Zoning Administrator approval, up to 24 feet at the roof peak above a detached garage, and 18 to 20 feet near transit.
- Check parking. Conversion ADUs and JADUs need none. A new-construction ADU needs one space unless the lot is within a half mile walking distance of a transit stop, in a historic district, or near a car-share vehicle.
- Submit through ePlan. The county reviews ADU building permit applications within 60 days of submittal, all online. Then come permit issuance and the usual foundation, utility, and final inspections.
When we build your Aptos ADU, the ePlan submission, corrections, and county coordination are our job, and a permitting budget is built into your one project price. Your exact county fees are confirmed in your feasibility study.
The county’s fee waivers are unusually good
Santa Cruz County waives more than the state requires: building permit fees for conversions, connection fees for JADUs and conversions, planning permits for units of 750 square feet or less, and impact fees for units under 750 square feet.
That makes the 750 square foot line the key budgeting decision in Aptos. Our lineup has six models under it, from the 450 square foot studio at $199,000 to the 749 square foot two-bedroom at $369,000, all-inclusive of construction. On a one-acre-plus parcel, our 1,200 square foot three-bedroom becomes an option too. The county-wide rulebook, including Live Oak and Soquel, is covered in our Santa Cruz County ADU regulations guide.
Two Aptos-specific realities
The 30-day rule. Short-term rental of an ADU or JADU is not allowed in unincorporated Santa Cruz County; rentals must run longer than 30 days. The strong long-term rental demand between Cabrillo College and the beach neighborhoods makes that an easy trade. Our guide on ADU rental income covers what units actually earn.
Wooded and sloped parcels. Plenty of Aptos lots sit under redwoods or on grades. That affects foundation engineering and crane planning more than permits, and it is exactly what our free site assessment checks. Factory building helps here: the home arrives about 97% complete from our Salinas factory, roughly 35 minutes away, so on-site disturbance stays minimal.
Frequently asked questions
Who issues ADU permits in Aptos?
Santa Cruz County, not a city. Applications go through the county’s online ePlan process and are reviewed within 60 days of submittal, ministerially, with no public hearing.
How big can my Aptos ADU be?
On lots under 1 acre: 850 square feet for a studio or one-bedroom, 1,000 square feet for two or more bedrooms. On 1 acre or more: up to 1,200 square feet. At least 800 square feet is always allowed on any lot.
What fees do I actually pay?
Less than most places. The county waives impact fees under 750 square feet, planning permits at 750 square feet or less, and several fees entirely for conversions and JADUs. We itemize the exact remaining fees for your parcel in the feasibility study, and they are included in your contract price.
Can I rent my Aptos ADU short-term?
No. County rules require rental terms longer than 30 days for ADUs and JADUs. Long-term tenants, family, or a home office are the intended uses.
