ADU Permits in Capitola: The 2026 Process, Fees, and Timeline

Capitola may be one of California’s smallest cities, but the ADU rights on your lot are the same ones state law guarantees everywhere: a detached ADU on nearly any single-family parcel, ministerial approval within 60 days of a complete application, 4 foot side and rear setbacks, and never less than an 800 square foot, 16 foot tall unit no matter what local standards say (Government Code sections 66310 to 66342). Capitola follows the state baseline, and state law preempts any stricter local rule.

The short version: State law is the rulebook in Capitola. The local layer is the coastal zone (much of the city sits inside it), which can add a coastal permit step but still no public hearing. Lots here are compact, so smaller footprints and smart placement carry the day. We manage the entire process, with a permitting budget built into one project price.

The Capitola ADU permit process, step by step

  1. Anchor on the state guarantee. Up to 1,200 square feet detached where standards allow, at least 800 square feet always, no owner-occupancy requirement, at most one parking space with broad exemptions. Citations in our Can I build? rules lookup.
  2. Check the coastal zone map. Much of Capitola sits in the coastal zone, where a coastal permit step can apply. For ADUs it stays hearing-free; it adds documentation and calendar time, not neighborhood politics.
  3. Design for a compact lot. Capitola parcels, especially near the Village and Jewel Box, are tight. This is small-footprint territory: our 405 square foot one-bedroom measures 27 by 15 feet, and the 450 square foot studio fits lots most builders would walk away from.
  4. Prepare a complete application. Site plan, floor plans, structural, Title 24, plus any coastal documentation. The 60-day ministerial clock starts on completeness, so the package quality is the schedule.
  5. Plan check, permit, inspections. Objective review, then foundation, utilities, crane set, and final inspection.

When we build for you, every step, including coastal paperwork, is our job, and a permitting budget is built into the one project price. Your exact fees are confirmed in your feasibility study.

Know your boundaries (literally)

Capitola is barely two square miles, and jurisdiction changes fast at its edges. Soquel and much of the 41st Avenue corridor’s residential streets are unincorporated Santa Cruz County, where a different, lot-size-based rulebook applies, and the City of Santa Cruz has its own generous ADU chapter a few minutes up the coast. Getting the authority right on day one avoids re-drawing plans later; it is the first thing our free property analysis confirms. For the county rulebook, see our Santa Cruz County ADU regulations guide.

One more local note: like its neighbors, this part of the coast treats ADUs as long-term housing. Plan on tenants staying 30 days or more, not vacation rentals, and let the year-round rental demand of a beach town do the work. Our rental income guide covers what that looks like.

Capitola ADU fees

State law waives impact fees for ADUs under 750 square feet, and larger units pay proportionally. Six of our 14 models stay under the line, from the 405 one-bedroom at $239,000 to the 749 square foot two-bedroom at $369,000, all-inclusive of construction. Whatever your parcel’s exact fee schedule, the feasibility study itemizes it and the contract price includes it.

How long the permit takes

Budget the 60-day ministerial window from a complete application, plus coastal lead time where the zone applies. How fast the paperwork clears is the city’s call to make, not ours. Meanwhile the build does not wait: your home is about 97% finished in our Salinas factory, roughly 38 minutes away, while the paperwork runs, and delivery is a single crane day instead of months of trucks squeezing down a beach street.

Frequently asked questions

Can I build an ADU on a small Capitola lot?

Almost certainly yes. State law guarantees at least an 800 square foot, 16 foot unit on virtually every single-family lot, and setbacks are capped at 4 feet on side and rear. On genuinely tiny parcels, our 405 and 450 square foot models are designed for exactly this.

Does the coastal zone stop ADUs?

No. It can add a coastal permit step with extra documentation, but ADU review remains ministerial, no hearing, no discretionary veto. It affects the calendar, not the outcome.

Can I rent my Capitola ADU as a vacation rental?

Plan on no. ADUs in this area are intended for long-term occupancy, 30 days or more, and we design the rental math around year-round tenants, which in Capitola is a strong market anyway.

My street might be county, not city. Does it matter?

Yes, materially: unincorporated Santa Cruz County ties ADU size to lot size and runs its own ePlan review, while Capitola applies the state baseline. We confirm your jurisdiction as the first step of the free property analysis.

“My first telephone conversation with Cathy (Owner) was one of the best, positive and kind discussions. She was thinking outside of the box and provided a possible solution like a family member. Thank you.”
